WAJID ALI VS GOVERNMENT OF PUNJAB Ss. 3 & 4---Contract employment---Regularization---Doctrine of legitimate expectancy---Applicability---Petitioner / civil servant was aggrieved of not regularizing his service from contract basis into regular service---Validity---Prior to expiry of extended period of contract, case of petitioner for regularization was put up before competent authority with positive note---Case of petitioner was covered under the principle of legitimate expectancy---Inconsistent conduct of competent authority was established from the fact that on one hand while filing report and parawise comments before High Court, it had opposed prayer of petitioner for regularization on the premise that he was not in service after 08-09-2023 and was not entitled for regularization, but on the other gauged service of petitioner as satisfactory while recording his remarks in Annual Confidential Reports---When competent authority imposed major penalties against a co-employ inter-alia on account of filing frivolous complaints against his seniors and other co-employees, the complaints filed by that co-employee could not be used to detriment of petitioner depriving him of his regularization---High Court directed competent authority to extend contract period of petitioner w.e.f. 09-08-2023 and to issue formal letter regarding regularization of his services with effect from completion of three years of his service from the date of his initial appointment, upon fulfillment of all codal formalities---Constitutional petition was allowed, in circumstances.
