SAIMA NAUREEN VS GOVERNMENT OF THE PUNJAB art. 199---Civil service---Directions passed by High Court in its constitutional jurisdiction---Scope and effect---Order of the Court having attained finality---Effect---Termination order was assailed by employee of TEVTa and High Court passed certain directions to TEVTa / Department---Employee resorted to High Court again as her termination was maintained by the Department / respondent---Record of previous constitutional petition revealed that the respondent No.2 (General manager -Operations TEVTa) was categorically directed to: (i) attend to the petitioner's grievance; (ii) pay her salaries; and (iii) regularize her duties as per the rules---However, in the impugned order, respondent No.2 did not address said directions and instead observed that neither the petitioner had fulfilled the required criteria nor was she eligible for appointment to the said post in TEVTa---Moreover, the said order dated 12.11.2018 was not challenged by the respondent/Department and therefore had attained finality---Hence, the impugned order was illegal, unlawful and had been passed without proper adherence to the directions of this/High Court and the relevant laws while the petitioner's fundamental rights had been violated, particularly in light of her successful completion of the probation period and her consistent service record---High Court set-aside impugned order as well as termination order---Constitutional petition, filed by employee, was allowed.
