SAIF NADEEM ELECTRO (PVT.) LTD. VS FEDERAL BOARD OF REVENUE, ISLAMABAD Definition and prerequisites---Malicious prosecution is defined (in the 11th edition of Black's Law Dictionary) as “The institution of criminal or civil proceedings for improper purpose and without probable cause"---The tort requires proof of four elements (i) the initiation or continuation of a lawsuit; (ii) lack of probable cause for the lawsuits initiation; (iii) malice; and (iv) favorable termination of original lawsuit”.
