SYED NASEER BURHAN VS AZAD GOVERNMENT. Ss. 8 & 12---Mutation---Scope---Past and closed transaction---A mutation confers no title and once a mutation is challenged, the party relying thereon is bound to revert to the original transaction, which resulted into the entry of attestation of such mutation. In the present case, the petitioners were precluded from questioning the legality of a previous Government order at a later juncture, as they failed to challenge the same at the proper forum and the same had become a past and closed transaction. A past and closed transaction could not be reopened in the garb of another ancillary issue. The petition, lacking substance, was dismissed in the circumstances.
