IFTIKHAR AHMED alias Papu VS State. Ss. 302(b), 324, 337-F(iii), 109, 148 & 149---Qatl-i-amd, attempt to commit qatl-i-amd, ghayr-jaifah-mutalahimah, abetment, rioting armed with deadly weapons, unlawful assembly---Reappraisal of evidence---Ocular account not proved---Accused-appellants were charged for committing murder of the son of complainant and causing firearm injuries to the complainant---Complainant was statedly an injured eye-witness of the case but he did not appear in the witness box because as per record, he died before recording of his evidence by the Trial Court---As regards the evidence of the remaining prosecution eye- witnesses, it was noted that according to the evidence of Investigating Officer of this case, appellant, co-accused since acquitted, were also injured in this case apart from other co-accused since acquitted, however, the said co- accused except other co-accused, refused to get them medically examined---Medico Legal Report of co-accused since acquitted, was brought on the record---Perusal of the said reports showed that the injury of co-accused since acquitted, was declared to be punishable under Section 337F(v), P.P.C., due to the fracture of the bone of left thigh and his injury was caused with a firearm---In the relevant column of Medico Legal Report of injured co-accused, since acquitted, the Medical Officer had categorically mentioned that there was no possibility of fabrication of the injury of the said co-accused---Circumstances established that the prosecution had failed to prove its case against the appellant beyond the shadow of doubt---Appeal against conviction was allowed, accordingly.
