IFTIKHAR AHMED alias Papu VS State. Ss. 302(b), 324, 337-F(iii), 109, 148 & 149---Qatl-i-amd, attempt to commit qatl-i-amd, ghayr-jaifah-mutalahimah, abetment, rioting armed with deadly weapons, unlawful assembly---Reappraisal of evidence---Motive not proved---Accused-appellants were charged for committing murder of the son of complainant and causing firearm injuries to the complainant---As per contents of the FIR, about two (02) days prior to the occurrence, a quarrel took place and abuses were exchanged between deceased and all the accused persons---Joint motive was alleged against all the accused but ten (10) co-accused had already been acquitted in this case by the trial Court and the High Court---No specific motive was alleged against appellant---Moreover, the prosecution evidence qua the motive had been disbelieved by the High Court, therefore, the prosecution could not prove the motive against the appellant---Circumstances established that the prosecution had failed to prove its case against the appellant beyond the shadow of doubt---Appeal against conviction was allowed, accordingly.
