CAPITAL DEVELOPMENT AUTHORITY (CDA), through Chairman, Islamabad VS Dr. SHEIKH MUHAMMAD SHOAIB SHAFI. Counsel''s negligence---Litigant''s responsibility to stay vigilant---Litigant bound by conduct of his counsel---Principle---Exception---A party cannot relegate the whole accountability to his lawyer or the Court but is expected to make inquiries for regular updates regarding the progress of the lawsuit---However, in the interest of justice, the Courts may intervene if the absence of counsel was due to circumstances beyond control, such as death or incapacitation of the lawyer or owing to force majeure circumstances, which can be distinguished from ordinary or gross negligence.
