SAEED AHMED VS NESTLE PAKISTAN LIMITED. Disciplinary proceedings---Misconduct---Burden of proof---Employer's obligation to prove misconduct. In disciplinary proceedings under Industrial Relations Laws, primary burden rests upon employer to prove misconduct through clear, credible and reliable evidence. When employee challenges termination or dismissal, employer must establish that action was based on independent, unbiased and lawful reasons. Principles of natural justice and due process must be followed before terminating employee. Before declaring employee guilty of misconduct, due diligence is mandatory because consequences are serious for delinquent employee.
