MUHAMMAD MUMTAZ VS State. Ss. 302(b), 324, 337-F(iii), 337-F(vi) & 34---Qatl-i-amd, attempt to commit qatl-i-amd, ghayr-jaifah-mutalahimah, munaqqilah, common intention---Reappraisal of evidence---Substitution of real culprit with an innocent person unlikely---Related witnesses suffering loss of close family members---Accused-petitioner was charged for committing murder of the mother and sister-in-law of the complainant by firing and causing firearm injuries to the brother of the complainant---Record showed that one deceased lady was the mother of the eye-witnesses, while the other deceased lady was the sister-in-law of the complainant and wife of the injured witness---It did not appeal to reason that eye-witnesses, who had lost such close relations, would spare the real culprit and falsely implicate an innocent person---Closely related eye-witnesses, who had themselves witnessed the occurrence and suffered loss of close family members, were highly unlikely to falsely implicate an innocent person while allowing the actual offender to escape---Possibility of substitution in such circumstances was extremely remote and, in the facts of the present case, beyond the realm of probability---Circumstances established that the prosecution had succeeded in proving the guilt of the petitioner-convict; however, due to mitigating circumstances, sentence of death on two counts was converted into imprisonment for life on two counts---Petition was converted into an appeal and was partly allowed.
