MUHAMMAD MUMTAZ VS State. Ss. 302(b), 324, 337-F(iii), 337-F(vi) & 34---Qatl-i-amd, attempt to commit qatl-i-amd, ghayr-jaifah-mutalahimah, munaqqilah, common intention---Reappraisal of evidence---Prompt lodging of FIR---Consultation and deliberation excluded---Accused-petitioner was charged for committing murder of the mother and sister-in-law of the complainant by firing and causing firearm injuries to the brother of the complainant---Record showed that the occurrence took place on 09.03.2015 at about 7:30 a.m., in front of the house of the complainant, in which two ladies were shot dead, while the injured witness sustained firearm injuries---Occurrence was reported by the complainant at 8:30 a.m., i.e. within one hour of the incident---Distance between the place of occurrence and the Police Station was about seven kilometres, as reflected in the FIR---Keeping in view such distance and the fact that the complainant was confronted with the unnatural death of his mother and sister-in-law, as well as injuries sustained by his brother, the time of one hour consumed in arranging transportation and shifting the dead bodies and injured appeared natural and reasonable---First Information Report was thus lodged with promptitude, which effectively ruled out the possibility of consultation or deliberation on the part of the complainant in making the report---Circumstances established that the prosecution had succeeded in proving the guilt of the petitioner-convict; however, due to mitigating circumstances, sentence of death on two counts was converted into imprisonment for life on two counts---Petition was converted into an appeal and was partly allowed.
