OSAMA VS State. S.302(b)---Qatl-i-amd---Re-appraisal of evidence---Benefit of doubt---Recovery of weapon---Proof---Last seen evidence, principle of---Applicability---Accused was convicted and sentenced to imprisonment for life---Validity---Till recovery of pistol, the empty was not sent to Forensic Science Laboratory to ascertain that it was fired from which weapon---Empty and pistol both remained together in Malkhana till recovery of weapon and, thereafter, were sent to Forensic Science Laboratory---Both the Courts below rightly disbelieved Forensic Science Laboratory report--- Facts did not form chain of uninterrupted events connecting accused with alleged crime---Last seen evidence and its constituents, i.e., probability, cause, and connection were missing, therefore, accused was entitled to benefit of doubt---Supreme Court set aside judgments of the Courts below and acquitted accused of the charge---Appeal was allowed.
