MUHAMMAD ZUBAIR VS State. S.302(b)---Qatl-i-amd---Re-appraisal of evidence---Chance witness, evidence of---Benefit of doubt---Accused persons were convicted by Trial Court and sentenced to death for committing qatl-i-amd but High Court converted the sentence into imprisonment for life---Validity---Evidence of two prosecution witnesses, which was characterized by inconsistencies and improbabilities and was reliant on chance and related witnesses, fell short of such rigorous standards---Both prosecution witnesses were unable to provide an explanation for their presence at the location of incident at the precise moment---Actions of both the prosecution witnesses during incident were unnatural, as they failed to raise any alarm, notify police promptly nor attempted to intervene despite being five in number---Location of occurrence in scaled site plan was distinct and had raised significant doubts regarding prosecution's case---Prosecution failed to establish culpability of accused persons beyond a reasonable doubt---Supreme Court set aside conviction awarded to accused persons and acquitted them of the charge as recovery of weapon was inconsequential and the motive was discarded---Appeal was allowed.
