SADDAM KAKAR VS State. Ss.302(b), 144, 109 & 34---anti-Terrorism act (XXVII of 1997), S.7---arms Ordinance (XX of 1965), S. 13-D---Qatl-i-amd, joining unlawful assembly armed with deadly weapons, abetment, common intention, act of terrorism, possession of illicit weapon---Reappraisal of evidence---accused were charged for committing murder of the deceased by firing---SK (appellant), was arrested at the spot by the officials of police and rangers, immediately after the occurrence while carrying a Kalashnikov---Prosecution eye-witnesses stated before the Trial Court that on the day of occurrence i.e., on 21.12.2012, at about 08.00 p.m., deceased was brought to the hospital in injured condition, who was attacked by the culprits and the said culprits tried to run away after the occurrence---Eye-witnesses along with others chased the culprits and apprehended one of the accused, who disclosed his name as SK (appellant)---Kalashnikov along with a magazine having seventeen (17) live bullets was recovered from the possession of SK (appellant)---Said witnesses were cross-examined at length but their evidence could not be shaken---Said witnesses remained consistent on all material aspects of the case and their evidence was confidence inspiring and trustworthy---Circumstances established that the prosecution case against SK (appellant) had been proved beyond the shadow of any doubt for offences under Sections 302/34, P.P.C. and 13-D of the arms Ordinance, 1965, however offences under Sections 7(1)(a) and 7(2) of the anti-Terrorism act, 1997, were not attracted, thus were set-aside and said accused was acquitted from the said charge---With said modification in sentence, appeal against conviction was dismissed.
