UMER JAN VS State. Ss.302(b), 324 & 34---Recovery of weapon of offence---Evidentiary value. Recovery of weapon from accused was not sufficient when forensic evidence did not conclusively connect all empties with recovered weapons. Selective reliance on evidence by High Court was contrary to settled principles of appreciation of evidence. Benefit of doubt extended to accused. Appeal allowed and appellant acquitted.
