UMER JAN VS State. Ss.302(b), 324 & 34---Criminal Procedure Code, S.340(2)---Khyber Pakhtunkhwa Arms Act, S.15---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Reappraisal of evidence---Benefit of doubt. Defence plea of cross-firing between parties was consistent from inception and supported by evidence. Investigating Officer admitted that villagers informed him about prolonged cross-firing between parties. Admissions of Investigating Officer supported defence version and created serious doubt in prosecution case. Supreme Court converted petition into appeal and acquitted appellant.
