MRS. TASNEEM ABBAS VS ADDITIONAL DISTRICT JUDGE, LAHORE. S.15---Specific Relief Act (I of 1877), S.42---Tenant claiming ownership over rented property by filing suit for declaration---Effect. Pendency of civil suit filed by tenant claiming himself to be owner of rented premises cannot be a ground in eviction proceedings either to dismiss or stay proceedings before Rent Tribunal. Until tenant obtains decree from competent civil court declaring ownership, he cannot claim status of owner and avoid consequences of tenancy.
