AZHAR IQBAL VS STATE. S.302(b)---Constitution of Pakistan, Art.185(3)---Petition for leave to appeal---Death of complainant---Representation by legal heir. Complainant had died and his brother, who was also an injured eye-witness of the occurrence, sought permission to represent deceased complainant in petition for leave to appeal filed by accused persons against their conviction and sentence. Held, that brother of deceased complainant was competent to appear and represent the deceased complainant as he was also an injured eye-witness of the occurrence. Supreme Court allowed the brother of deceased complainant to appear in proceedings.
