SYED SAAD ALI VS FEDERATION OF PAKISTAN THROUGH SECRETARY MINISTRY. Each case has to be decided on its own facts---Every litigant deserves a fair chance of being heard---Decision of Court must be founded and structured on facts of the case. The Supreme Court emphasized that every case carries its own peculiar facts and circumstances and cannot be decided merely on the basis of general principles or assumptions divorced from the factual background. Held: Each case has to be decided on its own facts and the decision of the Court must be founded and structured upon the facts established on the record. Every litigant is entitled to a fair opportunity of being heard and adjudication must be conducted in accordance with the principles of natural justice. A Court while deciding a matter must examine the pleadings, evidence, applicable law and circumstances of that particular case rather than applying precedents mechanically without considering factual distinctions. The Supreme Court observed that justice requires an individualized determination of disputes because legal principles derive their proper application from the facts upon which they operate. Therefore, a judgment or precedent cannot be applied in isolation without examining whether the facts and circumstances of the case are comparable.
