MUHAMMAD AYUB, SHOP MANAGER BATA PAK. LTD VS MUHAMMAD RAHMAN. Art. 199---Constitutional jurisdiction of High Court---Concurrent findings---Interference---Permissibility. Interference in concurrent findings by the High Court is permissible only when such findings are shown to be illegal, perverse, or based on extraneous considerations. The jurisdiction exercised by the High Court under Article 199 of the Constitution is supervisory and constitutional in nature and does not extend to acting as a Court of appeal for re-appraisal of evidence or substitution of its own opinion in place of findings recorded by competent forums. Held: Concurrent findings of fact recorded by the Courts below ordinarily deserve respect and cannot be interfered with unless such findings suffer from a legal defect, are based upon misreading or non-reading of evidence, are perverse, arbitrary or founded upon irrelevant considerations. The High Court while exercising constitutional jurisdiction must remain within the settled limits of judicial review and cannot reassess evidence merely because another view of the matter may be possible. Where the findings recorded by subordinate forums are supported by evidence available on record and do not suffer from any illegality or jurisdictional defect, interference under Article 199 of the Constitution is not warranted. The Supreme Court reiterated that constitutional jurisdiction is not intended to provide a second appeal against concurrent findings of fact and interference is justified only in exceptional circumstances where such findings are legally unsustainable.
