MUHAMMAD AYUB, SHOP MANAGER BATA PAK. LTD VS MUHAMMAD RAHMAN. Art. 199---Constitutional jurisdiction of the High Court---High Court substituting its own view on disputed questions of fact---Scope---Reappraisal of evidence by High Court---Permissibility. The constitutional jurisdiction of the High Court under Article 199 of the Constitution is supervisory in nature and does not confer appellate powers upon the High Court to reappraise evidence and substitute its own view on disputed questions of fact. Held: The High Court, while exercising constitutional jurisdiction, may not substitute its own opinion on disputed questions of fact unless the findings of the subordinate fora are shown to be based upon gross misreading or non-reading of material evidence, are wholly perverse or unsupported by the record. The Supreme Court observed that Article 199 jurisdiction cannot be exercised merely on the basis of a perceived injustice or because another view of evidence appears possible. The High Court is not an appellate forum in constitutional jurisdiction and cannot undertake fresh appraisal of evidence as if deciding an appeal. Interference is justified only where findings of the subordinate authorities suffer from legal infirmity, perversity, jurisdictional defect or are founded upon irrelevant considerations. The constitutional jurisdiction of the High Court is meant to ensure that lawful authority is exercised properly and not to replace the decision-making process of competent forums on disputed factual matters.
