MUHAMMAD AYUB, SHOP MANAGER BATA PAK. LTD VS MUHAMMAD RAHMAN. Art. 199---Constitutional jurisdiction of High Court---Concurrent findings---Interference---Permissibility. The jurisdiction of the High Court under Article 199 of the Constitution is supervisory and discretionary in nature and interference with concurrent findings of subordinate Courts is permissible only in exceptional circumstances. Held: Concurrent findings recorded by competent Courts cannot be interfered with by the High Court in constitutional jurisdiction unless such findings are shown to be illegal, perverse, based upon misreading or non-reading of evidence or founded upon extraneous considerations. The Supreme Court observed that where findings of fact are based upon proper appreciation of evidence and are supported by the record, the High Court cannot substitute its own opinion merely because another view of the matter may be possible. The constitutional jurisdiction of the High Court does not authorize reappraisal of evidence or correction of every alleged factual error. Interference is justified only where the findings suffer from jurisdictional defect, patent illegality or perversity.
