MUHAMMAD AYUB, SHOP MANAGER BATA PAK. LTD VS MUHAMMAD RAHMAN. Art. 117---Burden of proof on party asserting a claim---Scope. The burden of proof rests upon the party who asserts a fact or seeks relief from the Court. Held: The absence of rebuttal by the opposite party does not automatically result in success of the claim where the party asserting such claim has failed to produce credible and reliable evidence. The Supreme Court observed that every litigant must establish his own case through legally admissible evidence and cannot rely merely upon weaknesses of the defence. A claim unsupported by convincing evidence cannot be decreed merely because the opposing party has failed to effectively contest it.
