USMAN MEHBOOB VS STATE. S.302(b)---Qatl-i-amd---Re-appraisal of evidence---Motive not proved---Sentence of Life Imprisonment appropriate. The accused was convicted for committing Qatl-i-amd and was sentenced to imprisonment for life. The occurrence took place during a Langar where numerous persons were present. The accused fired seven to eight shots at the deceased, who later succumbed to his injuries while being taken to hospital. The Supreme Court observed that the discrepancies pointed out in the statements of the prosecution witnesses were only minor and insignificant. The High Court had thoroughly examined the evidence and rightly concluded that the prosecution failed to establish motive. It was only on that basis that the High Court converted the death sentence into imprisonment for life. The Supreme Court reiterated that where motive remains unproved, imposition of the death sentence is ordinarily not warranted. Since motive had not been established, awarding capital punishment would have been unduly harsh. The judgment of the High Court was based upon sound reasoning and disclosed no illegality, irregularity or misreading of evidence warranting interference. Accordingly, the petitions for leave to appeal were dismissed.
