ABDUL MAJEED SOHAIL VS MUHAMMAD MEHBOOB-UZ-ZAMAN KHAN. Section 114, Qanun-e-Shahadat Order, 1984---Review jurisdiction---Scope---Mistake apparent on face of record---Scope of interference. Petitioner was aggrieved of dismissal of his application seeking review of order passed by High Court. Validity---Issue regarding co-ownership of property had already been considered by High Court in the order sought to be reviewed. No error, omission or flaw was found in the order under review so as to warrant interference through review jurisdiction. Petitioner failed to point out any justifiable reason or patent illegality which could justify exercise of review jurisdiction. Scope of review jurisdiction was held to be very limited and confined only to mistakes apparent on the face of record, which are floating on the surface or patent shortcomings in the order which have escaped consideration. Review jurisdiction cannot be exercised for re-appraisal of evidence, rehearing of arguments or substitution of another view on merits. No ground was available for interference with the order passed by High Court. Petition for leave to appeal was dismissed and leave was refused.
