ASIM GULFRAZ VS State. Section 377-B, Pakistan Penal Code, 1860---Sexual abuse---Reappraisal of evidence---Minor victim as witness---Scope. Accused was charged for sexually abusing minor son of complainant. Minor victim in his statement before the Court deposed that accused took him to an under-construction shop where he was forcibly subjected to sexual intercourse. Minor victim further stated that after returning home he narrated the occurrence to his mother, who immediately took him to police station where the matter was reported. Victim also stated that he was medically examined by Medical Officer and he identified petitioner-convict during identification parade conducted inside jail. No beneficial inference for defence and no adverse fact against prosecution could be extracted from statement of minor victim during cross-examination. In the present case, victim was a minor boy of about eight years of age who returned home within half an hour of occurrence and immediately narrated the incident to his mother. A child of such tender age could not reasonably be expected to devise or fabricate a false story within such a short span of time. Immediate narration of occurrence by victim carried hallmark of truth and spontaneity. Testimony of minor victim was found reliable and confidence inspiring. Petition being devoid of merit was dismissed.
