ASIM GULFRAZ VS State. Section 377-B, Pakistan Penal Code, 1860---Sexual abuse---Reappraisal of evidence---Medical evidence---Corroboration of victim's account---Scope. Accused was charged for sexually abusing minor son of complainant. On the very day of occurrence, minor victim was medically examined by Woman Medical Officer. Woman Medical Officer stated that upon examination she observed scratch marks on both sides of neck of victim. Anal swabs of victim were obtained by Surgery Department, sealed and handed over to police for forensic analysis. Victim was thereafter referred to Medical Officer, who upon clinical examination noted scratch marks on both sides of neck just below jawline, visible bruises in perianal region and fissures at 5, 6 and 8 o'clock positions, though without active bleeding. After arrest of petitioner-convict, he was produced before Medical Officer on 26.09.2019, who obtained his blood sample for DNA analysis and referred him to Urologist. According to statement of Urologist, petitioner-convict was medically examined and was found capable of performing sexual intercourse. Investigating Officer took into possession clothes of victim, including trousers bearing semen stains, and deposited the same before Forensic Science Agency along with DNA blood samples of victim. Blood sample of petitioner-convict obtained by Medical Officer was deposited by police before Forensic Science Agency on 07.10.2019. As per Forensic Science Agency Report, seminal material was detected on stained portion of victim's trousers. DNA profile developed from sperm fraction of trousers matched with DNA profile obtained from blood sample of petitioner-convict. Buccal swab standard of victim also matched correspondingly, thereby eliminating possibility of contamination or error. Forensic Science Agency Reports provided strong forensic corroboration of minor victim's account and conclusively connected petitioner-convict with commission of offence. Medical evidence and forensic evidence fully supported prosecution case and reinforced credibility of victim's statement. Petition being devoid of merit was dismissed.
