MUHAMMAD WASEEM VS State. Section 302(b), Pakistan Penal Code, 1860---Qatl-i-amd---Reappraisal of evidence---Benefit of doubt---Recovery articles---Doubts in evidence---Scope. Accused were charged for committing murder of father of complainant with hatchet blows. Matter of record was that manner in which parcels of hatchets were handed over to Investigating Officer for onward transmission to Forensic Science Agency was shrouded with mystery and created doubt regarding delivery of articles in proper and legal manner. At the time of recovery of hatchets at instance of accused, no independent person from village was associated as witness and their names were also not mentioned in deposition of Investigating Officer. Recovered hatchets did not match with sketch prepared in recovery memo and such aspect remained unexplained. It was also unexplained why Investigating Officer did not send hatchets and blood-stained clothes for DNA analysis. When all circumstances were considered collectively, prosecution case was found surrounded by doubts and contradictions. Evidence of prosecution witnesses also contained inconsistencies creating doubt regarding occurrence. Prosecution failed to prove case against accused beyond reasonable doubt. Petition was converted into appeal and allowed in circumstances. Appellants were acquitted.
