SHAKEEL AHMED KAYANI VS THE MANAGING DIRECTOR/CHIEF EXECUTIVE OFFICER, ISLAMABAD. Articles 9 & 14, Constitution of Pakistan---Employment---Pension---Right to pension---Entitlement and scope. Pension is not a matter of bounty, charity or benevolence. It is a right protected under Articles 9 and 14 of the Constitution and is inseparably connected with right to life, dignity and livelihood. For public servants, pension represents deferred wages earned through years of service, labour and loyalty. Denial or withholding of pension deprives a retired employee of security and exposes him to indignity, vulnerability and hardship. Right to pension must be protected in a manner ensuring adequacy, predictability and respect consistent with constitutional values of dignity. Law protects such employees against arbitrary erosion of their long-earned entitlements. To interfere with pensionary rights is to interfere with constitutional justice itself.
