IMRAN VS STATE. Medical evidence---Scope---Nature and evidentiary value of medical evidence---Identification of assailant. Petitioner-accused was charged that he along with his co-accused committed murder of the brother of complainant. The prosecution relied upon medical evidence regarding the injuries sustained by the deceased and the nature of weapon used in the occurrence. Held: Medical evidence is only supportive evidence, which may confirm the ocular account with regard to receipt of injury, nature of injury and kind of weapon used in the occurrence, but it would not identify the assailant. Medical evidence by itself cannot establish the identity of the accused as the person who caused the injuries unless there is reliable ocular account or other independent corroborative evidence connecting the accused with the commission of offence. The Supreme Court held that medical evidence has a limited scope and it cannot be used as a substitute for direct evidence regarding the identity and participation of the accused. Where the ocular account is doubtful and other pieces of evidence are not sufficient to connect the accused with the offence, medical evidence alone cannot sustain conviction. Appeal against conviction was allowed, in circumstances.
