IMRAN VS STATE. Absconsion---Scope---Effect of abscondence of accused upon conviction and sentence. When a person is named as a murderer in a criminal case, whether rightly or wrongly, he usually becomes scared and tries to conceal himself in order to avoid possible police torture and detention. Held: Mere abscondence of an accused by itself is not sufficient to maintain his conviction and sentence in the absence of other reliable and trustworthy evidence. Abscondence is a circumstance which may create suspicion against an accused, but it cannot take the place of substantive evidence required to prove guilt beyond reasonable doubt. The prosecution is required to establish its case through reliable evidence and the fact that an accused remained absent from his normal place of residence cannot independently prove his involvement in the offence. Where the ocular, medical and circumstantial evidence available on record does not inspire confidence, mere abscondence cannot be used as a basis for maintaining conviction. The Supreme Court held that abscondence alone has no decisive evidentiary value and cannot be made the sole ground for conviction of an accused.
