IMRAN VS STATE. Medical evidence---Scope---Medical evidence as corroborative piece of evidence---Identification of assailant. Medical evidence is only supportive evidence which may confirm the ocular account with regard to receipt of injury, nature of injury and kind of weapon used in the occurrence. Held: Medical evidence does not identify the assailant and cannot by itself establish the guilt of an accused. The primary role of medical evidence is to provide confirmation regarding the injuries sustained by the deceased, the possible manner of occurrence, the nature of injuries and the weapon used, but it cannot replace direct evidence or independently connect an accused with the commission of offence. Where ocular account is found doubtful or unreliable, medical evidence alone cannot be relied upon for maintaining conviction of an accused. The Supreme Court reiterated that medical evidence is merely corroborative in nature and cannot be treated as substantive evidence for the purpose of identification of the offender. Therefore, unless the prosecution successfully establishes the involvement of accused through reliable and trustworthy evidence, medical evidence cannot be used to fill the gaps in the prosecution case.
