SECRETARY TO GOVERNMENT OF KHYBER PAKHTUNKHWA COMMUNICATION AND WORKS DEPARTMENT, CIVIL SECRETARIAT, PESHAWAR VS INAYAT ULLAH. Departmental Promotion Committee---Deferment of meeting by department---Subsequent revision of promotion rules during deferred period of meeting---Effect on pending promotion cases---Department's reliance on revised rules---Legality and permissibility. Whoever fulfills the prescribed eligibility conditions acquires a legitimate expectation to be considered for promotion in accordance with the prevailing rules. The respondents had fulfilled the eligibility requirements under the applicable promotion rules and their cases had become mature for consideration by the Departmental Promotion Committee. The department could not defeat such legitimate expectation by postponing the meeting of the Departmental Promotion Committee and subsequently relying upon amended promotion rules introduced during the period of deferment. The delay caused by the department in convening the meeting of the Departmental Promotion Committee could not operate to the prejudice of the employees who had already acquired the right to consideration for promotion under the rules then in force. The subsequent amendment in the promotion rules could not be applied to pending promotion cases where the employees had already fulfilled the prescribed eligibility criteria.
