AMJAD ALI VS State. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Benefit of doubt---Dishonest improvements made by eye-witnesses. Petitioner was charged for committing murder of husband of complainant by inflicting rifle-butt blow on left side of his head. Contents of FIR mentioned only one injury caused by petitioner with butt of rifle on left side of head of deceased. However, according to medical evidence brought on record through Medical Officer, there were two lacerated wounds on left side of forehead and left temporal area of deceased. There was conflict between ocular account mentioned in FIR and medical evidence of prosecution. In order to bring their evidence in line with medical evidence, prosecution eye-witnesses made dishonest improvements in their statements before Trial Court and stated that petitioner inflicted butt blows of rifle on left side of head of deceased. Said evidence was in conflict with story narrated in FIR where there was no mention of any second blow with butt of rifle. As prosecution witnesses had made dishonest improvements to bring their statements in line with postmortem report, their evidence was not worthy of reliance. Circumstances established that prosecution had failed to prove its case beyond reasonable doubt against accused-petitioner. Appeal against conviction was allowed accordingly.
