AMJAD ALI VS State. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Benefit of doubt---Night time occurrence---Source of light not mentioned. Petitioner was charged for committing murder of husband of complainant by inflicting rifle-butt blow on left side of his head. Occurrence in this case took place on 08.10.2011 at about 2.00/3.00 a.m. (night), but no source of light had been mentioned in contents of FIR or site plan or in evidence of prosecution eye-witnesses. Under the circumstances, identification of petitioner in darkness of night was not free from doubt. Circumstances established that prosecution had failed to prove its case beyond reasonable doubt against accused-petitioner. Appeal against conviction was allowed accordingly.
