WAJID UR REHMAN VS LATIF UR REHMAN. S.497(2)---Pakistan Penal Code (XLV of 1860), Ss.392 & 411---Robbery, dishonestly receiving stolen property---Bail, grant of---Further inquiry. Allegations against accused-petitioner were that he along with co-accused trespassed into house of complainant and committed robbery and took away Rs.27,00,000/- in cash, foreign currency, gold ornaments and laptops. Petitioner was arrested on 16.11.2024, however, he was nominated by complainant on 28.11.2024. Record showed that no identification parade was arranged. No plausible explanation was given by complainant as to why identification parade was not conducted when FIR specifically mentioned that inmates of house could identify culprits if brought before them. High Court declined bail on ground that jewellers had stated that petitioner and co-accused sold gold ornaments to them, however, said jewellers who allegedly received stolen articles were not made accused under Section 411, P.P.C. Record further showed that CCTV footage provided to police was not shown to complainant and eye-witnesses for identification. Previous FIRs mentioned against petitioner were not sufficient as petitioner had not been convicted in any case. Case of petitioner called for further inquiry under Section 497(2), Cr.P.C. Petition was converted into appeal and allowed and petitioner was enlarged on bail.
