MUHAMMAD SIDDIQUE VS State. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Unexplained delay of one day in conducting postmortem examination---Consequential. Accused was charged for committing murder of son of complainant through firing. Postmortem examination of deceased was conducted on following day of occurrence i.e. 15.09.2015 at 12:20 a.m. No explanation, much less a plausible one, was furnished by prosecution for such delay. Unexplained delay in conducting postmortem examination raised serious doubts regarding veracity of ocular evidence and presence of alleged eye-witnesses at spot at time of occurrence. Petition was converted into appeal and allowed and accused was acquitted of charge.
