MUHAMMAD SIDDIQUE VS State. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Inconsistencies and improbabilities in prosecution case. Accused was charged for committing murder of son of complainant through firing. Complainant stated that two daughters of petitioner-convict were married to his two sons. One daughter of accused married to deceased was living with complainant along with their three children in cordial and harmonious relations. Other daughter of accused was living in her parental home due to strained relations with her husband. In such circumstances alleged murder of deceased, against whom petitioner-convict had no motive, was wholly incomprehensible. Complainant failed to provide any cogent explanation as to why petitioner-convict would commit such grave offence against son-in-law with whom no animosity existed. Such inconsistencies and improbabilities made prosecution case highly doubtful. Petition was converted into appeal and allowed and accused was acquitted.
