MUHAMMAD SIDDIQUE VS State. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Unexplained delay of more than five hours in lodging FIR---Consequential. Accused was charged for committing murder of son of complainant through firing. As per FIR, occurrence took place on 14.09.2015 at 06:00 p.m. but matter was reported to police at 11:20 p.m. after unexplained delay of more than five hours despite police station being merely 17 kilometers from place of occurrence. Such delay, without satisfactory explanation, not only eroded credibility of prosecution case but also rendered presence of alleged eye-witnesses doubtful. Complainant failed to furnish any explanation for delay in lodging FIR. Unexplained delay in reporting occurrence created doubt in prosecution case and its benefit had to be extended in favour of accused. In absence of plausible explanation, delay in lodging FIR was fatal as it cast suspicion on prosecution story. Petition was converted into appeal and allowed and accused was acquitted of charge.
