MUHAMMAD SIDDIQUE VS State. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Presence of eye-witnesses and complainant at spot doubtful. Accused was charged for committing murder of son of complainant through firing. Claim of alleged eye-witnesses that they were grazing cattle at fag end of the day appeared highly improbable. Complainant's cross-examination further cast shadow of doubt on his presence at spot. Complainant admitted that someone from spot informed him about occurrence and people advised him not to approach police station as petitioner-convict was armed with Kalashnikov and might kill him as well. If complainant had actually witnessed incident, it defied logic and normal human conduct that others would need to inform him about accused's presence or advise him not to visit police station. Petition was converted into appeal and allowed and accused was acquitted of charge.
