RASHEED AHMAD alias SHEEDA VS State. S.302(b)---Qatl-i-amd---Reappraisal of evidence---Delay of 15 hours and 20 minutes in conducting postmortem examination upon the dead body of deceased due to delay in receiving police papers---Consequential. Accused-petitioner was charged for committing murder of wife of his brother/daughter of complainant by firing. Occurrence took place on 30.07.2012 at 06:30 pm whereas postmortem examination was conducted on 31.07.2012 at 09:50 am and there was delay of fifteen hours and twenty minutes. Medical Officer stated that dead body was received in mortuary on 30.07.2012, however, complete police documents were received on 31.07.2012 at 09:45 am and thereafter autopsy was conducted. It was evident that delay in conducting postmortem examination was result of delay in handing over police documents to Medical Officer. Such delay was also suggestive of the fact that prosecution eye-witnesses were not present at the spot and delay was consumed in procuring attendance of fake eye-witnesses. Circumstances established that prosecution failed to prove its case beyond reasonable doubt. Petition was converted into appeal and was allowed and accused was acquitted of the charge.
