Mst. ADDAN (Deceased) VS PROVINCE OF SINDH Ss.42 & 54---Sindh Land Revenue Act (XVII of 1967), S.52---Qanun-e-Shahadat (10 of 1984), Art.49---Civil Procedure Code (V of 1908), O.VI, R.4--- Suit for declaration and injunction---Entries in revenue record---Presumption---Fraud---Proof--- Appellants/plaintiffs challenged gift deed after 27 years of its execution in favour of respondent/defendant on the allegation of fraud. Supreme Court held that a party alleging fraud was required to provide specific particulars of fraud and sufficient material and evidence in support thereof. In absence of particulars, material or proof, presumption attached to official record could not be ignored. Long standing entries in revenue record, particularly record of rights, carry presumption of truth under Article 49 of Qanun-e-Shahadat, 1984 and cannot be displaced by mere oral evidence. Appeals were dismissed.
