IRSHAD KHAN VS STATE. Criminal proceedings---Maxim "communi observantia non est recedendum"---Applicability---Principle of criminal jurisprudence. The principle of criminal jurisprudence arising out of the maxim "communi observantia non est recedendum" means that when the law prescribes a specific procedure, it must be followed accordingly and any deviation renders the act questionable. The Supreme Court held that where the law provides a particular mode or procedure for taking any action in criminal proceedings, the same procedure is mandatory and departure from such prescribed course affects the legality and validity of the proceedings. The maxim "communi observantia non est recedendum" embodies the settled principle that established legal procedure cannot be departed from and compliance with the procedure prescribed by law is essential for maintaining the sanctity of criminal proceedings.
