AMEENULLAH VS State. S.9(c)---Possession of narcotic substances---Re-appraisal of evidence---Chain of safe custody---Burden of proof. Prosecution, by producing unimpeachable evidence, had to prove that the chain of safe custody was unbroken, unsuspicious, indisputable, safe and secure. Any break in the chain of custody or lapse in the control regarding possession of the samples caused doubts relating to safe custody and safe transmission of the samples and, consequently, it impaired and vitiated the conclusiveness and reliability of the chemical report of the government analyst. Therefore, it rendered the conviction to be unsustainable. If the prosecution failed in establishing safe custody or safe transmission of the alleged drug then the chemical report of the government analyst became doubtful and unreliable. Appeal against conviction was allowed, in circumstances.
