IFTIKHAR alias Puppi VS State. Ss.302(b) & 394---Recovery of looted articles from accused---Inconsequential. No independent witnesses were associated during recovery proceedings. Golden ring, wallet containing Rs.2000/-, CNIC copy, pistol and cartridges were allegedly recovered. Despite availability of public persons and forest department officials at the time of arrest, no independent witness was joined. Recovery of motorcycle was also witnessed only by interested witnesses. Recovery alone was insufficient to sustain conviction. Jail petition was converted into appeal and allowed.
