IFTIKHAR alias Puppi VS State. Ss.302(b) & 394---Chance witnesses---Evidence of chance witnesses. Alleged eye-witness claimed that he was travelling from his village towards Chichawatni through route where occurrence took place. Witness admitted his village was 11 or 12 kilometers away and failed to explain reason for travelling through that route. He was therefore a chance witness. Complainant was cultivator and not employee of Forest Department but claimed that he was travelling between forest offices. Occurrence took place inside forest area whereas complainant belonged to another place. No plausible explanation was given for his presence. Presence of complainant and witness at place of occurrence became doubtful. Jail petition was converted into appeal and allowed.
