MARKET COMMITTEE KARACHI VS AMIN AKBAR ALI DOSSA. Ss.2(a), 21, 22 & 24---Agricultural Produce Markets Act (V of 1939) (repealed). Manufacturing of fishmeal for poultry feed in notified market area---Licence requirement. Question was whether fishmeal fell within definition of agricultural produce under relevant law. Held: Agricultural produce includes products capable of human consumption. Fishmeal used for poultry feed and not for human consumption does not fall within definition of agricultural produce. Schedule entry "Fish (Fresh and Dry)" does not include fishmeal because fishmeal is a processed product not intended for human consumption. Demand notice issued by Market Committee requiring licence was without lawful basis and was rightly struck down. Supreme Court observed that Sindh Wholesale Agricultural Produce Markets (Development and Regulations) Act, 2010 had not been implemented despite expiry of moratorium period. Civil petition was dismissed and leave to appeal was refused.
