ASAD KHALIL VS State. S.497(2)---Penal Code (XLV of 1860), Ss.302, 324, 148 & 149---Constitution of Pakistan, Art.185(3). Qatl-i-amd, attempt to commit qatl-i-amd, rioting armed with deadly weapons, unlawful assembly. Bail, grant of---Further inquiry. Allegation against accused was that he along with others fired upon rival group resulting in death of minor and injuries to two persons. Record showed occurrence was a case of cross firing between two groups. Minor died due to firing of rival group and legal heirs had compromised with accused persons of rival side. FIR contained joint role of cross firing against members of both groups. Although injury to one injured person was mentioned, FIR did not specify which accused caused such injury. Injured witness attributed injury to petitioner after one month and six days of occurrence through statement recorded under Section 161 Cr.P.C. No application was moved by Investigating Officer before Medical Officer regarding fitness of injured for recording statement. Petitioner was armed with firearm but injury attributed to him was on right knee and not on vital part. Attraction of Section 324 PPC required further inquiry. Case was of cross versions and question of aggressor and aggressed party was to be determined after evidence. Petitioner had no previous criminal record. Petition was converted into appeal and allowed. Post-arrest bail was granted.
