MUHAMMAD AMJAD VS State. Ss.302(b), 148 & 149---Qatl-i-amd, rioting armed with deadly weapons, unlawful assembly. Reappraisal of evidence---Benefit of doubt---Recovery of weapon of offence and crime empties---Negative forensic report. Accused were charged for committing murder of brother of complainant by firing. 30 bore pistol was recovered at instance of appellant; however, recovery became inconsequential due to negative forensic report from Forensic Science Agency. According to forensic report, empties recovered from spot were not fired from pistol allegedly recovered from appellant. Circumstances established that prosecution failed to prove guilt beyond reasonable doubt. Appeal against conviction was allowed.
