SHAHBAZ KHAN VS DOWLAT KHAN. O.XX, R.18---Suit for partial partition---Maintainability. A co-sharer cannot selectively choose valuable portions of joint property while excluding less valuable portions. Every co-owner has ownership rights in every part of joint property according to his share. Entire property corpus should be brought into common pool and partition should be carried out fairly considering area, location and nature of property. Partial partition causing discrimination between co-sharers is not permissible.
