SHAISTA QAISER VS ALTAF AHMAD KHAN. Maxim actus non facit reum nisi mens sit rea'---An act does not make a person guilty unless the mind is also guilty. Applicability---Most of the crimes require corroboration of both physical element (actus reus) and guilty mind (mens rea). Mens rea is the state of mind which is generally necessary to prove culpability in a criminal trial. However, in strict liability offences, it is sufficient to prove that accused committed the prohibited act, regardless of mental state. Guilty state of mind is immaterial in strict liability offences.
